Abstract:In 1984, Section 21.042 of the Texas Property Code was amended to allow for the benefit to a remainder of property condemned for highway purposes to be subtracted from the compensation paid for the part taken. Prior to this time, special benefits were allowed to be offset against damages to the remainder, but not against the value of the land taken. The overall goal of this research was to examine the impacts of this amendment on highway land acquisition cases. The amendment was declared unconstitutional in 1987. As a result, the immediate usefulness of the research has been reduced. However, the information presented should be useful to other State Departments of Highways and, possibly, the Texas State Department of Highways and Public Transportation (SDHPT) in the future. This report presents an overview of the highway right-of-way appraisal process, the role of the principal actors involved, and key factors which affect appraised values in highway condemnation cases.
