Abstract:As a recipient of US Department of Transportation funding, the Arizona Department of Transportation (ADOT) is required to administer a disadvantaged business enterprise (DBE) program aimed at providing DBEs fair opportunities to compete for federally funded transportation contracts. State departments of transportation (DOTs) are required to set an annual DBE goal and to achieve the maximum feasible portion of that goal using race-neutral strategies designed to assist all small businesses. The remainder of the goal may be met using race-conscious strategies focused specifically on assisting only DBEs (i.e., DBE contract goals). ADOT has implemented many race-neutral strategies but also uses DBE contract goals to meet its overall annual DBE goal. The purpose of this study was to identify additional strategies to assist ADOT in consistently meeting or exceeding the race-neutral portion of its goal and in eventually transitioning to race-neutral strategies as the primary means of achieving that goal. These strategies can generally be grouped into two categories: increasing opportunities for DBEs as prime contractors and consultants, and increasing the use of DBEs as subcontractors and subconsultants on contracts. To identify and recommend race-neutral strategies and practices most applicable to ADOT, researchers examined practices and features of state DOT DBE programs nationwide, including contracting practices and outreach and communication efforts. They also analyzed ADOT prime contracts awarded to DBEs and non-DBEs from October 2013 through September 2018.
