Abstract:The U.S. Department of Transportation's National Highway Traffic Safety Administration (NHTSA) encourages States to have laws that make it illegal for a person to operate a motor vehicle if he or she has blood or breath alcohol concentration (BAC) of 0.08 or more (i.e., an illegal per se law at this level). Alcohol concentration is to be based on either the number of grams of alcohol in 100 milliliters of blood or the number of grams of alcohol in 210 liters of breath. As of September 1, 1995, 13 States have an illegal per se law at the 0.08 level, 35 other States and the District of Columbia have illegal per se laws at the 0.10 level, and 2 States and the Commonwealth of Puerto Rico have no illegal per se law.
